Audrey Cherryl Mogan secures acquittal for section 18 and weapons offences after stabbing outside Scala Nightclub

The Defendant was charged with section 18 grievous bodily harm with intent, after CCTV cameras caught a fight outside Scala Nightclub at Kings Cross.

A co-defendant who pleaded guilty of section 18, was seen on the footage pulling out a machete and using it to attack the victim.

Charged under the controversial joint enterprise doctrine, the Crown’s case was that the four defendants acted together intending to cause really serious harm, even though only one of them had the machete.

Audrey’s defendant was seen to use a beer bottle to hit the victim after the machete attack.

Audrey’s careful cross-examination of the complainant resulted in his accepting that he had started the fight.

It was argued on behalf of the defendant that he did not know about the machete, did not intend really serious harm and did not have the beer bottle with him as a weapon.  

After a ten day trial at Wood Green Crown Court the jury unanimously agreed.
