Garden Court barristers feature in DLA Briefings July 2024 issue

Marc Willers KC, Ollie Persey and Oscar Davies' articles have been featured in Discrimination Law Association (DLA) Briefings July 2024 issue.

Marc Willers KC and Ollie Persey of the Garden Court Romani Gypsy and Traveller Rights Team co-authored the article 'High Court declares provisions in the Police Act incompatible with the rights of Gypsies and Travellers', which was featured in the DLA Briefings July 2024 issue. Marc and Ollie represented Wendy Smith, a Romani Gypsy,  in her successful claim.

In the article, Marc and Ollie set out the background to the successful challenge to new powers given to police to move Gypsy & Traveller families from unauthorised encampments and prohibit their return within 12 months.

Oscar Davies of the Garden Court Employment & Discrimination Law Team authored the article 'Gender critical cases: making bad law?', originally published as an April 2024 cover story in New Law Journal. This was also featured in DLA Briefings' July 2024 issue. 

In the article, Oscar argues that in recent gender critical cases, judges have taken the wrong approach, permitting the erosion of trans and non-binary people's rights, judges must focus on what the belief is, and whether it contains elements of transphobia, and, that if a belief is protected, the manifestations must comply with the Equality Act 2010, or the employer is likely to be justified in sanctioning the employee.
