The Court found that substantial damages are payable to the claimant for their detention between 8 September and 21 September 2015. The judge also concluded that if procedures had been properly followed, the claimant would have been lawfully detained between 24 August and 8 September. Therefore, only nominal damages are payable during that period.

Greg Ó Ceallaigh is a member of Garden Court Chambers’ Immigration Detention Team. He was instructed in the case by Siobhan Foulner of Wilsons Solicitors.
