NA (Iran) v Secretary of State for the Home Department [2011] EWCA Civ 1172

In a dismissed appeal against a 3rd country removal to Latvia of an Iranian national and her daughter, the Court of Appeal was critical of the UKBA’s policy guidance formulated in response to S.55(3) of the Borders Act 2009. In giving the lead judgement, Sir Stephen Sedley noted at para: 34: "What is conspicuously lacking in the policy,… is any slip-road for cases in which it has become apparent since the process was initiated that there is now a real risk of violating a Convention right if return is proceeded with."
