Michael Engelhardt-Sprack has successfully represented five employees who alleged that they were fired in retaliation for whistleblowing.

The Claimants, employed by a community organisation, had raised concerns through a collective grievance alleging financial and other misconduct by management, as well as risks to health and safety. All five employees were dismissed without any process, and within a few days of each other.

Michael was instructed via the Bar’s Public Access scheme at short notice. He drafted the statements of case before advising the clients on the preparation of witness and documentary evidence. At the hearing, he successfully argued that the evidence submitted crossed the high hurdle of s. 129 of the Employment Rights Act 1996, securing an order requiring the employer to continue to pay all five employees their full salaries until the conclusion of the case.
