The Defendant was charged with section 18 grievous bodily harm with intent after a fight between neighbours ended in an alleged stabbing. The Defendant’s cousin, a very vulnerable male, was charged alongside him.

The Defendant denied any use of a weapon and the complainant was cross examined in detail on the basis that he was the aggressor throughout. The complainant was also carefully cross examined on the fact that he had no permission to be inside his neighbours property on the night in question, resulting in his acceptance that he was a trespasser.

Audrey then made detailed legal submissions on the ‘householder defence’ and on appropriate directions to the jury when considering the level of force that would be reasonable in the circumstances where the complainant was an intruder.

After a six-day trial at Inner London Crown Court the jury unanimously acquitted both defendants of all charges against them.
