David Emanuel KC has succeeded in persuading the Criminal Cases Review Commission (CCRC) that the conviction for murder in the case of Jerome Bailey should be reconsidered by the Court of Appeal. This is on the basis that the Court of Appeal’s previous refusal of Bailey’s appeal was profoundly wrong.

This is a highly unusual basis for a referral, as the CCRC only considers an application that is not based on a new argument in exceptional circumstances.

The CCRC also referred, on a separate ground, that at the subsequent retrial for possession of a bladed article (the jury being hung on that count at the original trial), the evidence of a key eyewitness to the stabbing was significantly different to his evidence at the first trial. This cast doubt on the basis of the jury’s conviction for murder.

No date has yet been set for the murder appeal.
