The Court of Appeal has clarified the scope of the care home charging regime. The social services authority was represented by Stephen Knafler QC.

In R (Walford) v Worcestershire County Council, the Court of Appeal today allowed the appeal of the social services authority and clarified that the mandatory property disregard in the charging regime for residential accommodation only applied where a qualifying individual occupied the resident’s home before or at the time the resident first entered residential accommodation. The High Court had already clarified that the disregard only applied to main or only homes.
