In a case involving ground-breaking issues and a unique set of facts, the Court of Appeal considered a prosecution argument that a sentencing judge had passed an unduly lenient sentence in a conditional consent rape case.
In refusing the application, the Court adopted significant parts of David and Alex’s written arguments in their judgment in a case which is now set to be the leading authority on the subject.
