David was instructed one week prior to the hearing and redrafted grounds of appeal to argue that the 19 year old Appellant’s 9 month sentence of detention should be replaced with a conditional discharge, to reflect failings in the sentencing judge’s approach to the sentence of an adult who was under 18 at the time of the offending.
The Court agreed that the judge had misunderstood the post-release regime relating to licence conditions and concluded that, exceptionally, this was a case where justice required the imposition of a conditional discharge to reflect the large period of time that had been spent on remand.
