In some long marriages, particularly those involving significant assets, complex company structures can develop, especially when there are international elements and shareholding between spouses.

This seminar will break down the issues that arise, including how courts attribute contributions when a spouse has taken no formal role in the company. It will also explore common themes that family lawyers encounter when dealing with company assets, especially where spouses are employed within the business structure.

Topics covered will include:

  • Financial company structure complexities, particularly in divorce cases.

  • The intersection of company law and divorce, including shareholding and international elements.

  • Best practices for solicitors and barristers, offering insights from case law and real-life courtroom experiences.

Michelle Uppal, Family Partner, Lowry Legal (Chair)
Michelle is an accomplished and highly recognised matrimonial solicitor, accredited family mediator, and collaborative lawyer. She heads up the London office of boutique family firm Lowry Legal and has extensive expertise in matrimonial litigation, nuptial agreements, and cross-jurisdictional cases with an international dimension. Michelle is an active member of Resolution and sits on their Dispute Resolution Committee, advocating for all forms of non-court processes.

Ed Elliott, Barrister, Garden Court Chambers
Ed Elliott is a specialist family lawyer with over twenty years’ experience assisting clients with matrimonial finance proceedings and relationship breakdowns. He is a tenacious advocate with significant experience in complex cases involving third-party interests, the valuation and division of company assets, and international elements. He also deals with Trusts of Land and Schedule 1 proceedings, and advises clients on child maintenance, including representation in the First Tier (Child Support) Tribunal. Since 2019, Ed has served as a Deputy District Judge in the Family and County Court and sits as a Judge in the Financial Remedies Court in London.

Olamide Ogunrinade, Barrister, Garden Court Chambers
Olamide specialises in family law, with a focus on all areas related to children in both public and private law matters. Olamide also practices in financial proceedings, which includes matrimonial finance and applications under the Trusts of Land and Appointment of Trustees Act 1996 (ToLATA). Olamide’s practice also covers situations that may arise after the conclusion of proceedings which includes the enforcement of orders to sell the matrimonial home.

Stephen Lue, Barrister, Garden Court Chambers
Stephen Lue is a specialist family law barrister whose practice covers financial remedies in divorce cases. He represents wives, husbands and civil partners in all financial remedy applications, working with parties who have modest assets, as well as those with complex assets in multiple jurisdictions. Stephen advises on pre-marital and post-separation assets, inheritance, pensions and the division of assets based on contribution. He was shortlisted in the Legal Aid Lawyer of the Year Awards 2021 for Barrister of the Year.

David Muggridge, Owner and Director, Ackland Webb

He is a chartered certified accountant and an accredited expert witness and has over 20 years experience acting as an expert in a wide range of instructions. Having been born into a business-owning family, David understands the pressures and stresses associated with business ownership and has a good insight into the practicalities of business ownership and management. Combined with his technical experience, this enables David to provide pragmatic advice and sound reasoning for clients and instructing solicitors alike.
