In this webinar, speakers examined the protections enshrined in the Equality Act 2010 and their use in the field of housing law. They updated delegates on the latest decisions in relation to topics including:

  • How to address proportionality under section 15;
  • The caselaw on reasonable adjustments;
  • The effect of recent victories in establishing quantum for Equality Act claims and counterclaims;
  • Developments in the caselaw on the PSED;
  • Practice points (including questions of evidence) from the tenant's attempt to be restored to the housing register after allegations of nuisance in Willott, R (On the Application Of) v Eastbourne Borough Council [2024] EWHC 113.

Tessa Buchanan, Garden Court Chambers (Chair)
Tessa practises primarily in the fields of housing, community care, administrative and public law, human rights, discrimination, and Gypsy and Traveller law. She has a particular interest in homelessness and housing allocation matters. She is an author of Housing Allocation and Homelessness: Law and Practice (6th edition, Lexis Nexis, 2022) and Housing Law Handbook (2nd edition, Law Society, 2020). Tessa won Barrister of the Year at the Legal Aid Lawyer of the Year Awards 2021 and was the vice-chair of the Housing Law Practitioners’ Association for four years.

David Renton, Garden Court Chambers
David specialises in housing, discrimination and employment law. He acts for tenants and mortgagors in possession hearings, mainly where possession is defended on Equality Act, human rights or public law grounds. David is also regularly instructed in disrepair cases in the county court and magistrates' courts, carrying out work under both legal aid and no-win-no-fee agreements. He also appears in homelessness appeals under section 204 of the Housing Act 1996, in occupation orders, and in related cases involving the overlap of housing and family law. David is the author of Discrimination in Housing Law (Legal Action Group, 2024).

Nick Bano, Garden Court Chambers
Nick specialises in representing homeless people, residential occupiers, and destitute and migrant households in public law and private law disputes. He has acted in many of the most important housing law cases in recent years, including those concerning the threshold for defending possession proceedings, the Public Sector Equality Duty and discrimination against homelessness applicants. The legal directories consistently recognise his inventiveness and commitment to his clients. Nick also authored A Practical Guide to the Public Sector Equality in Housing (2023) and Against Landlords: How to Solve the Housing Crisis (2024).
