Returning someone home abroad – How does repatriation work in the Court of Protection?

With more and more people deciding to relocate to different parts of the world, in this webinar we considered the jurisdictional and practical issues encountered in cases when the Court of Protection is having to consider whether it is in a person’s best interest to;

1. Return / live permanently in a country abroad.

2. Travel on a temporary basis to visit family and friends abroad.

This webinar entailed an examination of the law and procedure in the Court of Protection for the repatriation or movement of persons lacking capacity to other countries.

Tim Baldwin, Barrister, Garden Court Chambers (Chair)
Tim is Co-Convenor of the Court of Protection and Mental Health Team and has considerable experience in Court of Protection proceedings concerning health and welfare decisions and Accommodation and Deprivation of Liberty Safeguards (DoLS) issues for applicants and all respondents, including emergency applications and instruction by the Official Solicitor. Tim is ranked in Chambers UK for Social Housing, Community Care, and Civil Liberties and Human Rights and is also identified as a leading junior in the Legal 500 for Social Housing, Court of Protection and Community Care, and Administrative Law and Human Rights.

 Amina Ahmed, Barrister, Garden Court Chambers
Amina practises primarily within the area of public law care proceedings, representing parents, children, local authorities and interveners. She has experience of cases involving complex non-accidental injury, sexual abuse and cruelty and neglect, and has acted in the Court of Protection. Amina acts in the Court of Protection dealing with issues of disputes over care planning for adults under a disability and financial deputyship.

Acland regularly appears in the Court of Protection accepting instructions from families, local authorities, accredited legal representatives (ALRs), integrated care boards (ICBs) and the Official Solicitor. Acland acts in a full range of the Court of Protection’s jurisdiction.
