We will also consider the following issues; Does the collaborative and informal decision making envisaged by Section 4 and Section 5 Mental Capacity Act 2005 actually work? Should there be an exception when considering those whom have never had capacity? Is there a requirement for better guidance for social care and medical professionals? What next?
Speakers
James Holmes, Barrister, Garden Court Chambers (Chair)
James is a specialist court of protection practitioner and is able to sit as a nominated judge of the court of protection. He regularly appears in the Court of Protection, accepting instructions from the Official Solicitor, families, local authorities and Accredited Legal Representatives. His expertise spans the full range of the Court’s jurisdiction, including welfare disputes, s.21A challenges, deprivations of liberty, and complex matters before the High Court, including where the inherent jurisdiction has been invoked. James has particular expertise in cases involving hoarding, forced marriage, challenges to capacity assessments and contested deputyship appointments. As a result of his background as a family law practitioner and as a Tribunal Judge in the Health, Education and Social Care Chamber, this further enhance his ability to handle complex, multi-disciplinary cases.
Alex Temple, Barrister, Garden Court Chambers
Alex is a barrister specialising in public law, discrimination and human rights. He has extensive experience in education, community care, policing and criminal records. Alex often advises children and vulnerable adults in cases arising from schools, colleges, exam boards, universities, integrated care boards and local and central government. He acts regularly in claims for judicial review, EHCP appeals and money claims. Alex has experience acting in proposed strategic litigation, and advises changemaking individuals and organisations.
