This training is split into two sessions and will be delivered by barristers from the Garden Court Chambers Immigration, Public Law and Civil Liberties Teams.

The Garden Court Chambers Immigration Team is the only set of barristers awarded the highest ‘Band 1’ status for immigration law advice by the independent Chambers Bar Guide rankings and the only set in 'Tier 1' of the Legal 500 rankings.

This immigration detention training will provide a broad introduction to the law in this area, including an introduction to civil claims arising from unlawful immigration detention and public law challenges to the legality of immigration detention. The training will also address additional claims which may arise, such as civil and public law claims arising from conditions of detention, the detention of vulnerable groups, and identifying possible trafficking claims.

Session 1: Introduction to immigration detention

1-2pm, Thursday 1 July 2021
Gordon Lee, Greg Ó Ceallaigh and Miranda Butler, all of Garden Court Chambers, will provide a broad introduction to immigration detention. They will cover when detention may be unlawful, Hardial Singh principles, unlawful policies, policies governing detention and public law errors in decisions that lead to detention. They will also address how to structure unlawful detention JRs and false imprisonment/damages claims.

Session 2: Specific issues, conditions of detention & victims of trafficking

1-2pm, Wednesday 15 September 2021
This training will cover specific issues associated with immigration detention, Raza Halim will discuss interim relief, strategy and disclosure, Zehrah Hasan will cover Foreign National Offenders (FNOs) and Emma Fitzsimons will address Adults at Risk/Victims of Trafficking (VoTs).
