This seminar will focus on practical tips for those working on the Housing Possession Duty Desk Scheme and the provisions under s10 Legal Aid Sentencing and Punishment of Offenders Act 2012, whereby individuals who are not otherwise entitled to legal aid may be entitled to “exceptional funding” to avoid a breach of their EU rights or their rights under the ECHR. This seminar aims to give an outline of the law and procedure for making such applications.

Practical tips for solicitors and advisors working on the Housing Possession Duty Desk Scheme including:

  • Identifying potential defences
  • Public law and proportionality
  • Ideas for dealing with ‘bedroom tax’ cases
  • How not to upset the District Judge

New exceptional funding regime under s.10 of the Legal Aid Sentencing and Punishment of Offenders Act 2012 including:
