In 2021, the Court of Appeal upheld a summary possession order in Global 100 v Laleva, holding that the guardians’ argument that they were tenants was not seriously arguable.  In this webinar, we will look at the Court of Appeal’s decision, consider whether there remain any viable defences to property guardian claims, and look at some of the related issues (such as housing conditions and standing to bring claims).

Speakers Profiles

Angharad Monk, Barrister, Garden Court Chambers (Year of Call: 2017) (Chair)
Angharad is a housing law specialist and is currently developing a practice in education and Court of Protection work. Before commencing pupillage Angharad was employed by the Hackney Community Law Centre as a housing paralegal. She has experience in the full range of housing work, including homelessness, possession and disrepair, in addition to accommodation-related aspects of community care law. Angharad also has an extensive background working with migrant projects in London, in particular the Hackney Migrant Centre and the Islington Unity Project (a project dedicated to assisting clients with applications to remove “no recourse to public funds” conditions from their leave to remain). She provided specialist advice in this context, helping clients navigate housing problems linked to complex immigration issues.

Stephen Cottle, Barrister, Garden Court Chambers (Year of Call: 1984)
Stephen is an expert in social housing, planning and property law. He has an established practice in housing and landlord and tenant covering most areas, including equality and discrimination issues, homelessness, possession claims including mortgage repossession, and housing standards and disrepair. Stephen was a finalist for the Legal Aid Barrister of the Year Award 2014. He is ranked in the Legal 500 and Chambers & Partners for his work in Social Housing. He is also ranked in the Legal 500 for his work in Civil Liberties and Human Rights.

Simon Mullings, Senior Caseworker, Edwards Duthie Shamash
Simon Mullings is a senior housing caseworker at Edwards Duthie Shamash, and represented the occupier in Global 100.  Simon specialises in housing and social welfare law and he is the co-chair of the Housing Law Practitioners Association. Simon has acted as housing possession court duty adviser across five east London County Courts and is co-author of a forthcoming Legal Action Group book on duty desk advice and representation. He is also a contributing author of the Legal Aid Handbook and writes regularly for the Legal Action magazine. Simon won the Social Welfare Legal Aid Lawyer of the Year award in 2020.

Nick Bano, Barrister, Garden Court Chambers (Year of Call: 2013)
Nick Bano specialises in housing and homelessness law, and represented the occupier in Global 100. Nick represents homeless people, residential occupiers, and destitute & migrant households in both public law and private law disputes. Nick has particular expertise in cases where equality rights and social entitlement overlap.  He has been involved in bringing some of the significant recent challenges in this area. Chambers & Partners recommends him as an ‘up and coming’ talent in the social housing field, saying ”his thriving practice takes in homelessness appeals, disrepair claims and possession proceedings, among others”.
