Part 1 – Preparing and making bail applications to the First-tier Tribunal: law and practice

This session will provide you with an understanding of the current landscape including the impact of Detention Action and Mikhail Ravin v Secretary of State for the Home Department (CO/1101/2020) and the First-tier Tribunal’s use of remote hearings for bail applications.
We will review underlying principles to detain for immigration purposes, and against this background, we will explore options for securing your client’s release. Drawing on our own experiences of remote bail hearings, you will also be provided with practical tips for preparing a bail application to the First-tier Tribunal.

Part 2 – Securing bail accommodation: law, practice and tactics

This session will examine the legal and administrative barriers to bail accommodation, which have been heightened by the current crisis. There are also opportunities to push for support for individuals who might otherwise have been refused.
We will review the s.95. s.4 and Schedule 10 regimes, issues of delay and suitability, and the likely judicial attitude to interim relief, drawing on our extensive public law, immigration and community care expertise.
