Hossein Zahir KC and Alex Rose of Garden Court Criminal Defence Team were instructed by Abu Kibla of Stuart Miller Solicitors.
The prosecution had alleged that KM was part of a group of armed men riding e-bikes and on a “violent rampage” in Kettering in January 2025.
Following extensive scrutiny of the unused material, the defence were able to demonstrate the unreliability of the complainant for the aggravated burglary charge during cross-examination, and the prosecution withdrew the charge from the jury at the close of the prosecution case.
In addition, under cross-examination by Hossein Zahir KC, the complainant in the robbery count conceded that KM was not one of the men that robbed him. The prosecution eventually offered no evidence on this charge.
Hossein Zahir KC and Alex Rose were able to demonstrate that KM was not armed, and that the group happened upon the deceased by chance, Counsel also demonstrated that KM did not physically participate in the murderous attack by other co-defendants – despite the presence of a forensic connection of KM to a knife, belonging to the deceased, recovered from the crime scene.
KM was acquitted of murder but convicted by his own plea on a limited basis to manslaughter and sentenced to seven years and ten months’ imprisonment.
