Housing team respond to government’s Choice Based Lettings guidance

Garden Court Chambers housing team has responded to the government’s consultation on guidance for implementing Choice-Based Lettings Scheme.

The draft guidance is published by the Department for Communities and Local Government. We regret that the government prefers to publish additional guidance, rather than taking the opportunity of re-writing the Allocation of Accommodation Code of Guidance for Local Housing Authorities which was published in November 2002 and requires updating.

We are concerned that those responsible for the present draft – in seeking to provide guidance of real assistance – have failed to address experience on the ground since the introduction of the current statutory framework in January 2003. There has been much published research on what has – and as importantly what has not – been happening and the statutory provisions have had repeated scrutiny in Court.
