New student rules came into force on 21st April, 2011 affecting Tier IV students of points based system. The new Immigration rules include tougher entrance criteria for students, limits on work entitlement for those not at university or publicly funded further education colleges and limits on higher study at degree level or above. Secretary of State for the Foreign Office & Commonwealth Affairs v (1) E Matfah (2) A Khaled [2011]
The Secretary of State requested as a preliminary issue the determination of whether inclusion of individuals on a list of persons suspected of a connection with terrorism and the consequent freezing of their assets involved or may involve the determination of a "civil right" within the meaning of article 6 of the European Convention on Human Rights. The Court held that it did not as the making or procuring of a freezing order was a discharge of public functions. The Court though doubted whether the issue would have any real impact on the conduct or outcome of the claims as there would not be a difference between the position at common law and under the Convention. RM (Zimbabwe) v Secretary of State for the Home Department [2011]
The Court of Appeal allowed the Secretary of State’s appeal and remitted the case back to the Tribunal for further consideration where an Immigration Judge had incorrectly applied the guidance in HS (Zimbabwe) v Secretary of State for the Home Department (2007) UKAIT 94 by concluding that the Zimbabwean authorities would irrationally detain a failed asylum seeker for a second stage interview.
