Francis, R (on the application of) v Secretary of State for Justice & Anor [2011] EWHC 1271 (Admin)
It was held that the failure to release a foreign national prisoner under the home detention curfew scheme was not unlawful, in spite of the Secretary of State’s policy erroneously stating that a detained person would be excluded from the scheme if they had been served with a detention authority, as Toulson LJ concluded that the decision had been made on a distinct lawful basis.
