Krolik & Others v Several Judicial Authorities of Poland [2012] EWHC 2357 (Admin) (17 August)
The Administrative Court in six joined extradition appeals rejected the claims that Polish prison conditions violate ECHR Article 3. The principle complaint related to overcrowding. The Court held that the evidence adduced did not begin to establish the type of evidence that would be required to rebut the presumption – that Poland, as a Member State of the Council of Europe, is presumed to be able and willing to fulfil its obligations under the Convention, in the absence of clear, cogent and compelling evidence to the contrary – and to find a breach of Article 3.

D, R (on the application of) v Secretary of State for the Home Department Admin Court (Charles George QC) (20 August 2012)
In respect to a Congolese asylum seeker who had a history of psychiatric illness, the SSHD’s failure to treat his mental health condition adequately whilst in immigration removal centres breached her public sector duty under the Equality Act 2010 s.149, her duty under the UKBA Enforcement Guidance and Instructions Chapter 55.10, and the claimant’s rights under ECHR, Arts 3 and 8.
