B2 v The Secretary of State For the Home Department [2013] EWCA Civ 616

The Court of Appeal found that a British citizen, born in Vietnam who was deprived of his British citizenship because of alleged involvement in terrorism activities would not be rendered de jure stateless within the meaning of section 40(4) of the British Nationality Act 1981. The Court of Appeal found on an analysis of the expert and other evidence presented to them that the person was de facto stateless but not de jure stateless for the purposes of the BNA 1981. R (Ali Zaki Mousa and others) v Secretary of State for Defence [2013] EWHC 1412

The High Court found that the scope of future hearings involving the ill treatment, torture and death of Iraqi citizens at the hands of the British armed forces required that there be inquests in individual cases and that all deaths should be Article 2 ECHR compliant. In particular, the Court found that all deaths be subject to full, fair and fearless investigations accessible to victims’ families and to the public into the circumstances of each death.
