EMPLOYMENT APPEAL TRIBUNAL
Statutory grievance procedure
Dick Lovett Ltd v Evans UKEAT/0211/07/JOJ
The Tribunal had erred in holding that explanations given in a meeting which took place subsequent to the purported grievance letter was part of the relevant context to be taken into account when deciding whether the original letter met the statutory requirements.
Redundancy pay
Optical Express Ltd v Williams UKEAT/0036/07/CEA
The Tribunal had erred in concluding that a right to a statutory redundancy payment survived, notwithstanding the operation of, but non-compliance with, the statutory procedure under s138 Employment Rights Act 1996.
Appeals
Todd v Cutter UKEAT/0063/07/ZT
The EAT would not allow the introduction of fresh evidence on appeal which, with reasonable diligence, could have been obtained for the hearing. Ladd v Marshall [1954] 1 WLR 1489 applied.
