Marc Willers KC has been instructed to represent four Ugandan farmers in an environmental case which has just been launched in the High Court of England and Wales against the UK registered company EACOP Ltd.
The case concerns the environmental impacts arising from the construction and operation of the controversial 1400 km long East African Crude Oil Pipeline (EACOP) project.
EACOP Ltd is a UK registered company and is responsible for the development, construction, and operation of the pipeline.
The Uganda claimants argue that EACOP Ltd is responsible for breaching Ugandan laws which are designed to protect the environment and their constitutional right to a clean and healthy environment.
The remedies sought by the Ugandan farmers could go to the heart of the EACOP project’s commercial viability as they will be seeking an injunction to stop oil being transported through the pipeline as well as compensation and other legal relief under Ugandan law.
The proceedings are believed to be the first in which an English court is asked to apply Ugandan climate and environmental law against a UK-registered fossil fuel company.
The project has attracted international attention and significant opposition from environmental organisations and affected communities.
