Mark Robinson of the Garden Court Crime Team acted for one of five defendants charged with murder following a fatal stabbing, in a trial at the Old Bailey (Central Criminal Court). The prosecution alleged that the defendants were responsible for the killing on the basis of joint enterprise.
Mark’s client maintained throughout that he had played no part in the fatal violence. The defence case focused on evidence showing that, earlier in the day, Mark’s client had intervened to restrain the deceased during an altercation and had actively sought to prevent further violence. The jury heard unchallenged evidence that Mark’s client had disarmed and restrained the deceased during the earlier incident, as well as CCTV footage showing him pushing the eventual perpetrator away shortly before the fatal stabbing. Telephone evidence was also relied upon to demonstrate the close relationship between Mark’s client and the deceased, undermining the prosecution’s case that the defendants were acting together with a common purpose.
After a six-day deliberation, the jury unanimously acquitted Mark’s client, along with three other co-defendants, of murder. The lead defendant was convicted, having admitted the stabbing but unsuccessfully advancing a case of self-defence. The verdict represents a clear rejection of the prosecution’s joint enterprise case against Mark’s client.
