In AA v Secretary of State for the Home Department, the High Court granted an injunction at an urgent ex parte interim relief hearing on Saturday 5 October 2024. The application became necessary because the Defendant failed to cancel removal directions in line with its published policy, after the Claimant lodged a judicial review claim in the Upper Tribunal on Friday 4 October 2024.

Mr Justice Bryan ruled that there was a serious issue to be tried in relation to the potential infringement of the policy and that the balance of convenience favoured an injunction, pending the determination of the judicial review claim.
