Ronan Toal has successfully represented a Filipino national in a significant human rights appeal before the First-tier Tribunal.
The case, heard at Hatton Cross, was allowed on Article 8 ECHR grounds following compelling evidence of the appellant’s vulnerability and the severe obstacles he would face – including those which are climate related – if returned to the Philippines.
The Tribunal accepted that climate-related hardship, loss of livelihood, poor mental health, and the risk of family separation created “very significant obstacles to integration” should the appellant be returned. Judge Adio cited expert medical and country evidence presented by Ronan, finding it credible and persuasive.
The appellant had lived in the UK since 2013 and worked as a carer. He suffered from PTSD and depression linked to his displacement and the destruction of his home in the Philippines following a typhoon. His partner, a British citizen, confirmed they would be unable to relocate with him.
The case was brilliantly prepared by instructing solicitor Gamal Basha who praised Ronan for the “invaluable expertise, insight and leadership” he brought to the case.
This judgment is a timely reminder of the intersection between climate change, displacement, and human rights, and underlines the importance of robust legal representation in complex protection claims.
