Tom Copeland secures acquittal in double attempted murder trial involving expert evidence

Tom successfully defended a young man charged with a double attempted murder at Birmingham Crown Court.

The defendant, a twenty-year-old man, had driven his car into three men on e-bikes, causing them serious injuries. The case involved critical evidence captured of the incident via a video doorbell.

Counsel reviewed expert evidence on the manner of driving and speed based on data recovered from the car. The prosecution expert produced a report asserting that the defendant was travelling at 39 miles per hour (mph). However, careful cross examination by Tom Copeland led to the expert conceding that, on impact, the actual speed could have been as low as 32mph.

The defendant provided detailed evidence over three days raising self-defence, which included reference to a series of relevant background events dating back to when he was twelve years old.

The jury unanimously returned verdicts of not guilty within an hour of deliberation.  The defendant was also cleared of lesser alternative charges of grievous bodily harm (GBH) with intent and causing serious injury by dangerous driving.

Tom was instructed from the outset of proceedings and had several conferences in advance of trial with the defendant and a defence expert.
