There are a series of recent examples where prisons have failed to release defendants despite court orders to do so.
This training event will offer practical guidance on making urgent applications for a writ of Habeas Corpus to ensure the release of clients unlawfully detained in custody.
The training will cover:
- Issues when considering whether to make an out of hours application to the High Court
- The procedure for making such applications
- Recent case law in this area
- Legal aid and other costs considerations.
