When financial impropriety is alleged against a company all those involved in the management of that business can find themselves the subject of scrutiny from a number of agencies, including the Department for Business, Innovation and Skills, the Serious Fraud Office and the police. They may find themselves facing potential criminal and civil proceedings and the prospect of being disqualified from being a director for a long period of time. Such orders can have serious ramifications for an individual’s livelihood and it is important to mount a coordinated and focused approach to such allegations at an early stage.
This webinar will set out the key factors to take into account in relation to such orders and provide an overview of the relevant law and procedure to be aware of when advising clients in such circumstances.

Tom Wainwright, Barrister, Garden Court Chambers (Chair)
Tom has appeared in some of the most high-profile cases of recent years and a number of large-scale international frauds. He has a particular interest and experience in Serious Fraud and Confiscation, Protest Cases, Terrorism, and Criminal Appeals. He has brought his analytical and advocacy skills to bear on large-scale complex frauds brought by the Serious Fraud Office, Trading Standards and the Department for Business, Innovation and Skills amongst others. He is particularly well-known for his expertise in confiscation proceedings and has co-authored ‘The Confiscation Manual’ – a practical guide to the proceeds of crime.
Oscar Davies, Barrister, Garden Court Chambers
Oscar is an award-winning barrister and is ranked as a Tier 1 ‘Rising Star’ in the Legal 500. They undertake a range of civil and public law work, including employment, education, human rights, commercial and property/housing. Oscar has appeared as sole counsel in numerous High Court commercial claims and multi-track disputes. They regularly provide advice on the directors’ duties and the mechanisms contained within the various Companies Acts. Oscar can advise throughout the insolvency process including in relation to statutory demands as well as final petitions both for creditors and debtors.
Shahida Begum, Barrister, Garden Court Chambers
Shahida Begum is a specialist criminal defence practitioner. She has experience defending clients in a range of matters and has experience with cases involving a cross-over with other practice areas. Shahida is able to marshal large amounts of financial material and identify the key issues. She has been instructed as a led junior and junior alone in several, large scale and complex fraud allegations. Shahida also has a great deal of experience in proceeds of crime matters. Shahida has experience conducting disclosure and LPP review for the FCA and SFO.
