This webinar will address the procedure and consequences of proscribing an organisation under the Terrorism Act 2000, and the impact that this has on members and supporters of such groups, as well as the chilling effect it may have more broadly in the UK on the right to freedom of expression.

Speakers will examine the procedure for proscription, potential routes of challenge and the criminal offences relating to proscribed organisations, including the Court of Appeal’s recent decision in R v ABJ [2024] EWCA Crim 1597.

Tom Wainwright, Barrister, Garden Court Chambers (Chair)
Tom Wainwright has a formidable reputation as a passionate defender and a powerful advocate. He has appeared in some of the most high-profile cases of recent years including the Colston statue topplers, the Hatton Garden burglary, the ‘Stansted 15’ protestors, representing the father of Jack Letts in his trial for funding terrorism and a number of large-scale international frauds. Tom has acted in a great many ground-breaking appeals, with twelve cases in the current edition of Archbold. Tom has a particular interest and experience in Serious Fraud and Confiscation, Protest Cases, Terrorism, and Criminal Appeals. He is regularly instructed as Leading Junior Counsel in high-profile cases of significant complexity and legal importance. As lead author on The Protest Handbook, Tom specialises in upholding protestors’ rights under Articles 8, 10 and 11 of the European Convention on Human Rights and challenging the excessive or unlawful use of force by police officers.

Owen Greenhall, Barrister, Garden Court Chambers
Owen Greenhall is a specialist in all aspects of the law relating to protest and freedom of expression and has extensive experience of litigation in this area. He acts in both criminal trials and civil claims relating to protests, including actions against the police and possession proceedings. He has provided pre-litigation advice to several national NGOs on criminal and civil liability for direct action protests. Owen is co-author of The Protest Handbook (2nd ed. Bloomsbury 2020) a leading textbook in the field. Owen regularly delivers talks and training sessions on protest law, addressing audiences ranging from small activist groups to members of the Welsh Assembly. Owen also is co-chair of the Netpol Lawyers Group, a group of protest lawyers affiliated to the Network for Police Monitoring.

Audrey Cherryl Mogan, Barrister, Garden Court Chambers 
Audrey Cherryl Mogan is a criminal defence and human rights barrister with experience in serious complex cases, including firearms, terrorism, fraud and serious drug offences. Audrey is also sought after for her expertise in protest law, working with victims of trafficking, and the criminalisation of refugees and asylum seekers. Audrey won Legal Aid Newcomer of the Year at the Legal Aid Lawyer of the Year Awards in 2021. Her background in international armed conflict, European human rights law, deportation, and asylum makes her well-qualified to advise on these matters within a criminal context. She is ranked in Chambers & Partners for Protest Law and is a sought-after junior in a range of high-profile cases in the Crown Court and Appellate Courts. She has successfully represented Just Stop Oil activists, those involved in the Bibby Stockholm protests, and individuals charged with violent disorder and riot arising from Black Lives Matter (BLM) protests.
