The SIAC team will discuss the recent Court of Appeal judgment of U3 v SSHD [2023] EWCA Civ 811 and discern its impact upon the Supreme Court case of Begum, and upon deprivation appeals more widely in SIAC and the Upper Tribunal.
In examining the threatened expansion of the Rehman national security approach to serious organised crime and fraud, and the jurisdictional reach of Article 8 ECHR, it will also assess whether SIAC has lived up to the promise of its creation: that it would provide a system that was fair enough.
