The defendant and the two co-accused were alleged to have stolen a large quantity of drinks and DJ decks from a bar in North London. The defendant maintained that the manager of the bar owed one of the co-defendants money over a hire car and invited the group to help themselves to alcohol and DJ decks to settle the debt. After the defendants collected the items, the manager then called the police.
The defendant maintained his position of proprietary rights, and this was set out in the defence statement that Mark drafted. The service of the defence statement caused the police to question the manager again, which then lead to the case being reviewed. It was found that the complainant and witnesses accounts lacked creditability. The prosecution then offered no evidence against all three defendants and not-guilty verdicts were entered.
