Challenge to High Court ruling that Palestine Action proscription was unlawful to be heard this week

The Home Secretary’s challenge to the High Court ruling that the proscription of the direct action group Palestine Action was unlawful is to be heard on Tuesday 28 and Wednesday 29 April 2026.

Owen Greenhall and Audrey Cherryl Mogan are acting as part of the legal team on behalf of the claimant, Huda Ammori, the co-founder of the group.

The High Court’s judgment allowed Huda Ammori’s claim on two of the four grounds of challenge, which the Home Secretary is appealing:

  • Ground 2: that the decision to seek proscription was contrary to the Human Rights Act 1998 as it amounted to an unjustified interference with the European Convention on Human Rights (ECHR) under article 10 (freedom of expression) and article 11 (freedom of association and peaceful assembly) and further, amounted to discrimination contrary to article 14 ECHR.
  • Ground 6: that the decision to proscribe Palestine Action was contrary to the Home Secretary’s own policy on exercising her discretion to do so (consideration of proportionality).

Ms Ammori is cross appealing on two other grounds.

The case is listed before a five-judge panel, including the Lady Chief Justice and the Master of the Rolls.
