The Appellant was represented by Edward Grieves KC, Helen Foot and Maha Sardar of the Garden Court Chambers Special Immigration Appeals Commission (SIAC) Team, instructed by Dr. Connie Sozi of Deighton Pierce Glynn.
SIAC allowed the application by the Appellant, F3, to extend time under Rule 8(5) SIAC Procedure Rules when an Applicant must demonstrate that, due to special circumstances, it would be unjust not to extend time to appeal.
SIAC concluded that F3’s poor health and the “appalling” and “oppressive” detention conditions, where there are “severe restrictions on contact with the outside world” and “every day…presents a struggle for survival”, amounted to special circumstances.
